Terms of Use

These Terms of Use govern your purchase and use of the SessionTide website/store. They are separate from the End-User License Agreement, which governs your use of the Software itself; both apply together.

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of sessiontide.com (the "Site") operated by Juan Pedro Huici ("we," "us," or "our"), and your purchase of SessionTide software licenses through the Site. By using the Site or completing a purchase, you agree to these Terms. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding contract, to purchase a license through the Site.

3. Purchases and Payment

Prices are listed in USD and may change at any time without notice; the price in effect at the time you complete checkout applies to your purchase. Payments are processed by Gumroad, a third-party payment provider. We do not store your full payment card details. By purchasing, you represent that you are authorized to use the payment method provided.

4. License Delivery

Upon successful payment, a license key and/or download link will be sent to the email address you provide at checkout. You are responsible for providing an accurate email address and for keeping your license key confidential. Use of the software itself, once licensed, is governed by the End-User License Agreement, not by these Terms.

5. Refund Policy

We offer refunds within fourteen (14) days of purchase if the Software does not perform as described. To request a refund, contact juanpedrohuici@gmail.com with your order number. Refunds are issued at our discretion and, once granted, your license key will be deactivated.

If you are a consumer located in the European Union or United Kingdom, you have a statutory right to withdraw from this purchase within fourteen (14) days of your order without giving any reason, under the EU Consumer Rights Directive (2011/83/EU) or the UK Consumer Contracts Regulations 2013. Because the Software is digital content delivered immediately upon purchase, by activating your license key before the 14-day period expires you expressly request immediate performance and acknowledge that you lose this statutory withdrawal right once the Software has been fully delivered.

6. Account Responsibility

If we provide you with an account, login credentials, or any other means of accessing your license or purchase history, you are fully responsible for all activity that occurs under that access and must notify us immediately at juanpedrohuici@gmail.com of any unauthorized use.

7. Acceptable Use

In connection with the Site, you agree not to:

Attempt to gain unauthorized access to the Site, other users' accounts, or our systems;
Use automated means (bots, scrapers) to access the Site without our prior written consent;
Circumvent, disable, or otherwise interfere with license activation, payment, or security features;
Use the Site for any unlawful purpose or in violation of any applicable law.

8. Intellectual Property

All content on the Site — including text, graphics, logos, and the SessionTide name and mark — is the property of Juan Pedro Huici or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

9. Third-Party Links and Services

The Site may link to or rely on third-party services (e.g., payment processors, analytics providers). We are not responsible for the content, policies, or practices of any third-party service, and your use of them is subject to their own terms.

10. Disclaimer of Warranties

THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or related to these Terms or your use of the Site shall not exceed the amount you paid us in the twelve (12) months preceding the claim. Nothing in these Terms limits our liability for the Software itself, which is governed separately by the End-User License Agreement.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last Revised" date on this page. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Argentina, without regard to its conflict of laws principles.
